1. Acceptance of Terms

By accessing or using unplastic.com (the "Site"), submitting your email address, or placing a Pre-Order, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site or submit any information.

You must be at least 13 years of age to use this Site. If you are under 18, you represent that you have obtained parental or guardian consent to use this Site and agree to these Terms on your behalf. By using the Site, you represent that you meet these eligibility requirements.

2. Medical and Health Disclaimer

THE CONTENT ON THIS SITE IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE MEDICAL OR DENTAL ADVICE. Nothing on this Site creates a doctor-patient or healthcare provider relationship between you and Unplastic.

3. Permitted Use and License

Unplastic grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes, subject to these Terms.

You agree not to:

  • Copy, reproduce, distribute, or create derivative works from any Site content without our written permission;
  • Use the Site for any commercial purpose or for any public display;
  • Attempt to gain unauthorized access to any part of the Site or its related systems;
  • Use automated means (bots, scrapers, crawlers) to access or collect content from the Site;
  • Impersonate any person or entity or misrepresent your affiliation;
  • Transmit spam, unsolicited communications, or harmful code;
  • Use the Site in any way that violates applicable local, national, or international law.

We reserve the right to terminate your access to the Site immediately, without notice, for any violation of these Terms.

4. Waitlist

By submitting your email address on our Site, you are joining our interest list ("Waitlist"). Joining the Waitlist does not constitute a purchase, reservation, or binding commitment of any kind. We may contact you by email regarding product availability, launch updates, and related news. You may opt out of marketing communications at any time by clicking "unsubscribe" in any email we send.

5. Founder Pre-Order

The Founder Pre-Order ("Pre-Order") allows you to reserve a place in Batch 01 of the unplastic retainer and lock in Founder pricing for all future retainer orders. By placing a Pre-Order, you agree to the following:

  • Estimated shipping: The unplastic retainer is targeted to ship in the second half of 2026. Shipping timelines are estimates and subject to change.
  • Refund guarantee: If Unplastic cannot deliver your retainer within the 2026 calendar year, you will receive a full refund of your payment. No additional action is required on your part.
  • No change-of-mind refunds: Except as provided above, Pre-Orders are non-refundable once the product has shipped to you, unless required by applicable consumer protection law.
  • Lifetime free replacements: Batch 01 Founders receive free retainer replacements for as long as they maintain an active Unplastic subscription, subject to normal wear conditions and Unplastic's replacement policies in effect at the time of the request.
  • Founder pricing: Your Pre-Order locks in Founder pricing for all future retainer orders placed under your account. Pricing is subject to Unplastic's pricing policies in effect at time of order.

Unplastic reserves the right to modify Pre-Order terms prior to fulfilment. Material changes will be communicated by email to all Pre-Order holders.

6. User Submissions and Feedback

If you submit feedback, suggestions, ideas, or other communications to Unplastic through the Site or by email, such submissions are non-confidential and will become the sole property of Unplastic. We will be entitled to use, reproduce, disclose, publish, and distribute such submissions for any purpose without restriction or compensation to you.

7. Third-Party Links

The Site may contain links to third-party websites or services. These links are provided for your convenience only. Unplastic has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. The inclusion of any link does not imply our endorsement of the linked site.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES MADE AVAILABLE THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, UNPLASTIC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. UNPLASTIC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SITE IS ENTIRELY AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL UNPLASTIC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY PRODUCTS OR SERVICES.

IN ALL CASES, UNPLASTIC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS OR RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100 USD) OR (B) THE TOTAL AMOUNT YOU HAVE PAID TO UNPLASTIC IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Unplastic and its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, your User Submissions, any use of the Site's content other than as expressly authorised in these Terms.

12. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or to the use of the Site or products purchased through the Site, shall be resolved by binding individual arbitration. You waive your right to a jury trial and to participate in a class action lawsuit or class-wide arbitration.

Class Action Waiver: YOU AND UNPLASTIC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Unplastic agree otherwise, the arbitrator may not consolidate more than one person's claims.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief from a court of competent jurisdiction solely for matters involving intellectual property rights.

13. Modifications to These Terms

Unplastic reserves the right to modify these Terms at any time. When we make changes, we will update the "Effective date" at the top of this page and, where changes are material, notify you by email at least thirty (30) days before the changes take effect. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms.

14. Termination

We reserve the right, at our sole discretion, to suspend or terminate your access to all or any part of the Site at any time, with or without cause, with or without notice, effective immediately.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed severable from these Terms and will not affect the validity and enforceability of any remaining provisions. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Unplastic regarding your use of the Site.
